Paul Maguire was on a charity ride from Basingstoke to Kendal when he was struck from behind by Dean Swift on the A5 at Tamworth. Visibility was good and a driver in front of Swift passed Maguire safely, but Swift collided with him. He claimed that wind had blown his van across the road, but forensic evidence and witness statements did not agree with this, instead indicating that the van had followed a steady course.
Swift was found guilty of causing death by careless driving at Stafford Crown Court in May 2016 and was sentenced the following month. He received a suspended sentence and the minimum 12 month driving ban.
